One common example of a principal/agent partnership that has fiduciary responsibility is when shareholders act as principals and elect management or C-suite people to act in their place as agents. Investors also act as principals in selecting investment fund managers who will manage assets.

The fiduciary must finalize the steps by creating an investment statement. This statement will contain all the details necessary to implement a specific strategy. The fiduciary can now proceed with the implementation and monitoring of the investment plan, as outlined in the previous steps.


A guardian/ward relationships allows a minor to have the legal guardianship transferred to an appointed adult. As the fiduciary of the minor, the guardian has the responsibility to ensure the child or ward receives appropriate care. This may include deciding where the child goes to school, providing suitable medical care, and disciplining them in a fair manner.


A state court appoints a guardian to take over when the natural caretaker of a minor is no longer able. A guardian/ward relationship in most states is maintained until the minor child attains the age of majority.

Without explicit consent, there is no way to make a profit from a relationship. According to Keech vs. Sandford, an English High Court ruling states that fiduciaries cannot make a profit in the United Kingdom. These benefits can either be monetary or more broadly, they can also be called an "opportunity".

A fiduciary must place the interest of their clients first, under a legal and ethically binding agreement. Importantly, fiduciaries are required to prevent a conflict of interest between the fiduciary and the principal. At the same time, fiduciaries are present across many other business relationships, such as corporate board members and shareholders.
Because many fiduciaries lack the skills and/or resources required to execute this step, the implementation phase is often performed with the help of an investment advisor. Fiduciaries and advisors should communicate with each other to ensure that a due diligence process is followed in selecting investments or managers.

Fiduciaries may be responsible for managing assets for another person or group. Fiduciary responsibility can be assigned to money managers, corporate officers, financial advisors and bankers.
Fiduciaries are responsible for reviewing expenses incurred during the implementation of the process. Performance reviews are not enough. Fiduciaries have a responsibility for funds being invested and how they are spent. Investment fees can have an immediate impact on performance. Fiduciaries need to ensure that fees for investment management are fair, reasonable, and affordable.

Instead of having to place their interests below that of the client, the suitability standard only details that the broker-dealer has to reasonably believe that any recommendations made are suitable for the client, in terms of the client's financial needs, objectives, and unique circumstances. A key distinction in terms of loyalty is also important: A broker's primary duty is to their employer, the broker-dealer for whom they work, not to their clients.

A fiduciary standard prohibits an investment advisor from buying mutual funds for clients. This is because they would receive a higher commission, or a lower fee, than an alternative that would cost the client less.
